Terms of Service
These terms are an agreement between you and VANONI SAS, a company registered in Uruguay that operates Brooks (“Brooks”, “we”, “us”). By creating an account or using Brooks, you agree to them. If you use Brooks for a brokerage or team, you confirm you’re allowed to accept these terms on its behalf.
Our Privacy Policy explains how we handle personal data, and it’s part of these terms.
1. What Brooks does
Brooks turns your listings, your face, your voice and public information about your business (such as your website and your reviews) into videos and a content calendar. It posts the videos you approve to the social accounts you connect: Instagram, Facebook, YouTube, TikTok and LinkedIn.
Brooks is in founding access. We’re adding and changing features often, and some may be marked as early or experimental.
2. Your account
- You must be at least 18 and use Brooks for your real estate business.
- Give us accurate information, and keep your sign-in secure. You’re responsible for what happens in your account.
- Tell us right away at support@usebrooks.com if you think someone else has used your account.
3. Your content and listings
You keep ownership of everything you give us: your listings, photos, descriptions, your likeness, your voice and your brand. You give us permission to store, process, adapt and publish that content, only to provide Brooks to you, for as long as you use it.
You confirm that you have the rights to the listing photos and information you give us, and any permission you need from your sellers, your brokerage or your MLS to market those listings.
4. Your likeness and voice
Brooks makes videos with a presenter and a voice based on your own face and voice. You may only give us your own likeness and voice, never anyone else’s. How you give and withdraw consent is explained on our Consent and Likeness page, and how we handle face and voice data is in our Biometric Data Policy.
5. AI-generated content
The videos Brooks makes are generated with AI. We label them as AI on every network that supports it, and we follow The Brooks Standard.
AI can get things wrong. You review every video and caption before it’s posted, and you’re responsible for checking that it’s accurate, including the facts about each listing.
6. Posting to social networks
- Brooks posts only what you approve, to the accounts you connect, with the settings you choose.
- You’re responsible for what’s published under your name, including following your MLS, your brokerage, fair housing and advertising laws, and any licensing disclosures you must include. Brooks writes captions that describe the home and never who it is “for”, but that doesn’t replace your own judgment.
- Each network’s own terms apply to your account on it: Instagram, Facebook, TikTok, LinkedIn and YouTube (below).
- By using Brooks’ YouTube features, you agree to be bound by the YouTube Terms of Service.
- Networks can reject, limit or remove posts, and they can change how their services work. We’ll tell you when a post fails, but we’re not responsible for a network’s decisions.
7. Who owns the videos
The videos, captions and other content Brooks makes for you belong to you, or to your brokerage if your brokerage holds the Brooks account. If a video includes licensed music or other licensed material, that part stays under its own license, and you can use it as part of the video.
We keep your videos so Brooks can reuse them in your future posts, and we use them only for that. We delete them when you delete them in Brooks, when you ask us to, or when you close your account.
Brooks itself (the software, our designs, our templates and our brand) belongs to us. If you send us ideas or feedback, we can use them without owing you anything.
8. What you can’t do
Don’t use Brooks to:
- publish anything illegal, misleading, discriminatory or that infringes someone else’s rights;
- make videos of anyone’s likeness or voice other than your own;
- market a property you’re not authorized to market;
- send spam or break any network’s rules;
- copy, reverse engineer, overload or try to break into Brooks or another user’s account.
We can remove content or suspend an account that does these things.
9. Fees
Founding members get founding pricing, agreed with us in writing before you start. Pricing, billing period, renewal and cancellation are set in the written agreement you sign before you start.
10. Ending your use of Brooks
You can stop using Brooks and close your account at any time. We can suspend or close an account that breaks these terms, or if we have to by law, and we’ll tell you why unless we’re not allowed to. What happens to your data when your account closes is explained in our Privacy Policy and on our data deletion page.
11. No guarantees
We work hard to keep Brooks running well, but we provide it “as is”. We don’t guarantee any particular result, such as followers, views, leads, listings or sales.
12. Limits on our liability
To the extent the law allows, we’re not liable for indirect or consequential losses, such as lost profits or lost business, and our total liability for any claim about Brooks is limited to the amount you paid us in the 12 months before the claim.
13. If someone makes a claim because of your content
If someone makes a claim against us because of content you gave us or approved for posting, or because you broke these terms, you agree to cover the reasonable costs of that claim.
14. Governing law
These terms are governed by the laws of Uruguay, except where the law of the place you live requires otherwise. Any dispute about Brooks goes to the courts of Montevideo, Uruguay, unless the law of the place you live gives you the right to bring it elsewhere.
15. Changes to these terms
When we change these terms, we update them here and change the date at the top. If a change is significant, we’ll email you before it takes effect.
